Types of Cases For Class Action Lawsuit.

Many people have heard of the concept of a class action lawsuit, and many have a vague sense that class action lawsuits are serious affairs that could mean big trouble for whatever company or entity is the defendant in the lawsuit. The reason that class action lawsuits are such serious affairs is that, if there are a large and significant number of defendants who are all alleging the same grievance or damage done to them by the defense that lends a particular weight to the preponderance of the available evidence. Class action suits are, by definition, not matters of He Said, She Said. They are pretty clear evidence in and of themselves that something may be seriously wrong in a given matter. Currently there is no Osmoprep class action and cases are being filed by individuals.

Here are the four types of cases that are most likely to become class action lawsuits, and are most likely to produce lawsuit settlement amounts that are quite large – usually at least seven figures – settled completely out of court.

Cases Filed Over a Defective or Flawed Product That Caused Injury

This type of case is not only the most common form of lawsuit filed in the United States, it is by far the most common type of class action lawsuit as well. Typically, a company will produce or sell a particular product that has some form of defect, whether that defect is in its design, construction or in the materials used to create it. Once it is released, whether the company acknowledges it or not, a class action suit can easily be filed by all of the people who bought the product and were harmed or placed in danger. In the case of Osmoprep phospho-soda, the FDA required an Osmoprep black box warning.

Cases Over a Mistake or an Intentional Withholding of Information Regarding a Product

Usually, these types of cases go along similar lines to cases filed over defective products leading to injury. These kinds of cases focus on a particular portion of the process of litigating against the manufacturers of a particular product. These types of class action suits can be difficult to pull together, though, because the plaintiffs need to show either gross negligence or deceit on the part of the defendant in order to be awarded damages.

Faulty or Damaging Services Rendered

These types of cases are a little less common, if only for the fact that most types of service-oriented companies have so many different variables at play regarding the services rendered. Services offered by an employee for a night shift will be completely different from those for a day shift, and so forth. However, if enough plaintiffs come together with provable damages related to the services rendered by a company, this can easily become a winning class action lawsuit.

Cases Where Employees Claim Discrimination, Unfair Working Conditions or Practices

This is probably the second most common class action suit in the United States today. Often, the employees of a given company will seek compensatory and punitive damages for harassment, unfair work practices or unfit working conditions. Then, all of the employees that worked for the company for a given set of time will be invited to join the class action suit.
