In the press not too long ago, bullying in the workplace has been highlighted when the chief executive of the National Bullying Helpline presented allegations that there had been instances of workplace bullying at No 10. Bullying at work is an issue that can be very prevalent within your company and is a situation that can if left to get out of hand result in the need for tribunal representation. The Unison survey of 2009 reported that bullying within the workplace has increased by 50 per cent over the last 10 years and one in three staff has claimed to be bullied within the past six months. The top forms of bullying at work include public humiliation, exclusion and isolation, excessive monitoring and criticism, intimidation and finally being spoken to in a disrespectful and rude manner. Even out of hours staff can be harassed by email and text message.

Employees that experience this type of bullying can make a claim for harassment or bullying via an employment tribunal. Employees can simply file a claim online. According to employment law an employee who has been bullied can resign claiming constructive dismissal, which means that they have been in effect forced to leave due to the unreasonable behaviour of their employer. Cases like this could cost a business up to £65,000 and can be particularly serious is the bullying can be proved to be based on factors such as race, age or sex.

Tribunals are held in public so can create adverse publicity, which makes them extremely damaging to any company. It is in a company's best interest to understand how to handle bullying swiftly and to work hard to develop a culture where bullying is not tolerated. At NorthgateArinso we offer expert help with employment law and all aspects of human resources.
